Nike has accused StockX of selling similar versions of its shoes and wants a federal judge to force the online marketplace to remove the alleged knockoffs from its website.
Nike ordered to provide information on counterfeit shoes and certification process in StockX lawsuit
Additionally, the court ordered Nike to provide documentation regarding its awareness of counterfeit products on the secondary market outside of StockX stores.
Nice detailed the 38 pairs of counterfeit sneakers the dealer received. According to reports, Nike visited the dealer and confirmed that the sneakers were fake, and the dealer would eventually receive a full refund.
StockX does acknowledge, however, that counterfeit products can slip through its review process. The company noted in the filing that its refund policy "addresses the rare circumstances in which counterfeit products may fall into the hands of consumers." This fact alone is sufficient to support any allegation that StockX knowingly or knowingly traded in such commodities. "
